JUDGES KEITH KYLE, JOHN DURYEA, AND ALANE LABODA, REFUSE TO ABIDE BY THE AMERICANS WITH DISABILITIES ACT The Americans with Disabilities Act requires all State Institutions to provide reasonable accondations to individuals that are impaired in their daily lives with a disability. Those in wheelchairs are entitled to ramps, those who are blind must have their seeing-eye dogs allowed, and an individual with a severe stress disorder, and especally if they have a history of having a Life-Threatening Stress-Caused Heart Attack, like Billy Kidwell has, are entitled to "Low Stress Access" to those Public Facilities. Billy Kidwell has a severe stress disorder, called P.T.S.D., as a result of excessive combat in Vietnam as a "Honcho" where he was usually on his own in villeges. Kidwell rarely sleeps, and it is "normal" for him to go a week, or more, without sleep causing him to be extremely short on breath, and to have heart, and other serious problems, such as a stomach disorder, nerve itching, and at least one stress-caused heart attack. Kidwell also has one side numb, and a numb leg from a back injury where he was blown backwards while jumping off a truck to re-enforce the bunker line, durring a ground, and rocket attack, where Kidwell landed on strings of M-79 rounds he had on his shoulder, snapping his back. Kidwell has sores on his head that never heal, and bleed, from being constantly sprayed with Agent Orange. Kidwell has re-occurring maleria.
Proof Kidwell is Disabled 1. Social Security found Kidwell to be disabled, and unable to engage in gainful employment, for life. 2. United States Administrative Law Judge Farr in Lexington, Kentucky found that Kidwell was in "far more life threatening combat then other troops" and found Kidwell to be completely disabled from the date of his Army Discharge. 3. The Military Order of the Purple Heart represented Kidwell, and Kidwell was found to be 100% Service-Connected by the Department of Veterans Affairs. 4. The President of the United States, Bill Clinton ORDERED the Surgon General of the United States to review Kidwell's Military Records and issue a report. The report found Kidwell completely disabled from combat in Vietnam. 5. The President of the United States called Kidwell on the phone, and also sent him a personal letter, saying he was glad to help Kidwell obtain his benefits, and the President of the United States thanked Kidwell for his extremely Honorable Military Service in Vietnam. 6. The State of Florida found Kidwell disabled for life and issued Kidwell a lifetime Hunting and Fishing License. 7. The State of Florida found Kidwell disabled for life and issued Kidwell Disabled DAV tags for his car, and disabled stickers.
Judge Keith Kyle Refuses to Abide by the Americans with Disabilities Act Kidwell filed a Pro Se Lawsuit against Gibson Guitar for cheating him, and in the Complaint described his many disabilities, fully explaining how he was disabled. When Kidwell found out a hearing was set before Judge Keith Kyle he sent letters to Judge Kyle explaining that he had life-threatening disabilities, consisting of a bad heart, and a severe stress disorder, and needed low stress access to the Court. Kidwell asked Judge Kyle to comply with the Americans with Disabilities Act by merely providing a low-stress enviorment at the hearing. Taking things slow, following the law, and, if necessary, taking a short break if the hearing starting getting out of hand, and stressful. This compliance would have cost the state little, or NOTHING, to comply with. Judge Keith Kyle REFUSED. At a hearing Judge Kyle allowed perjury by his good friend, Attorney Brian Beason. He allowed Attorney Beason to shout at the severely disabled Veteran. He refused to allow Kidwell to address the perjury, or present evidence of the perjury, and Judge Kyle admonished, threatened, and harassed Kidwell for being unable to afford to hire counsel. Kidwell's heart started hurting. It felt like a truck was on his cheast, and Kidwell quickly put a Nitro pill under his toungue, trying to bear the stress of not even being allowed to address the perjury, and being harassed, and threatened. Judge John Duryea Also Refuses to Abide by the Americans with Disabilities Act Kidwell filed Formal Motions asking Judge John Duryea to abide by the Americans with Disabilities Act by providing low stress access to public accomidations for Kidwell, taking things slow, following the law, and, if necessary, taking a short break if the hearing starting getting out of hand, and stressful. This compliance would have cost the state little, or NOTHING, to comply with. Judge John Duryea also refused. At the hearing, Judge John Duryea admonished, belittled, and harassed the severely disabled Kidwell for filing a Complaint against Judge Kyle with Florida's Judicial Qualification Commission. Then Judge Duryea gave legal stragiety, and legal advice, to Attorney Beason, as a way of making sure Kidwell KNEW he had no chance, and that the case was fixed. Kidwell again got sick, felt like a truck was on his cheast, got short on breath, and this time got real light-headed and felt like he might pass out.
Judge Alane Laboda Also Refuses to Abide by the Americans with Disabilities Act Kidwell filed Formal Motions asking Judge Alane Laboda to abide by the Americans with Disabilities Act by providing low stress access to public accomidations for Kidwell, taking things slow, following the law, and, if necessary, taking a short break if the hearing starting getting out of hand, and stressful. This compliance would have cost the state little, or NOTHING, to comply with. Judge Alane Laboda absolutely refused. Both Kidwell, and Attorney Brian Beason, made a techinical error filing several motions with the wrong Court Caption. Attorney Beason's defective motions were filed, and acted on by the Court. Kidwell's motions, with the SAME, EXACT, mistakes Attorney Beason had made were STRICKEN by Judge Laboda, and she issued an ORDER belittleing, admonishing, and threatening Disabled Veteran Kidwell with Sanctions. The great disparity in treatment of the parties by Judge Laboda made it clear the case was FIXED, and that she was out to get Kidwell, to RETALIATE against Kidwell, for filing a Complaint against a fellow judge. [Kidwell's Judicial Qualifications Commission Complaint against Judge Keith Kyle.] The Court's failure to comply with the Americans with Disabilities Act aggrivated Kidwell's disabilities, causing depression, heart pains, stomach problems and caused Kidwell to miss a Court Deadline. Judge Laboda is now seeking SANCTIONS against Kidwell for being disabled.
Where is the A.C.L.U. that "claims" to be a watchdog over our Constitutional Rights? Where is the F.B.I. ? ______________________________ Until the laws that protect Civil Rights are enforced, and judges that eagerly violate those laws are put in Federal Prison where they belong, the Constitution is just a farce in Florida, and no citizen has any rights. The gangsters in power can do anything they want. And until Judges Keith Kyle, John Duryea, Alane Laboda, and the Good Old Boy Legal "Clique" they belong to, that is violating federal law, and misusing their Public Office fixing cases, is investigated, and prosecuted, no citizen going before their Courts has any meaningful rights.
